Independence Party Chairman Kipp Pells stated that the Independence Party denied Republican / Conservative, Adrian “Butch” Anderson the authorization to run in a Independence Party primary against Independence Party member Candis Saint Angel.  However, Anderson’s foot soldiers presented the Board of Elections with a designating petition anyway.  Since Anderson could not get Independence Party members to collect enough signatures for him, Republican and Conservative Party members collected for him, using notary stamps, a method Kipp Pells stated as violating a party rule.  A number of Conservatives / Republicans carried for both Republican, Conservative and Independence Party Designating Petitions.  Those on both sides included Arnold L. Baratta, Mary Ann McGaw, Edward P. Winters, Stanley A. Frangk, Richard J. Burke Jr., Donald Cappillino, Anna Marie L. Bossi, Michael Sarigianni, and Frank M. Mora.

Page 19 of their “petition” shows that Lauralynn E. Downing who gave her letter of resignation from the Independence Party Committee on May 4, 2003, obtained signatures not only for Republican / Conservative Adrian “Butch” Anderson, but also for Richard Anderson, the Democratic Candidate for County Clerk.  Insofar as only three other people carried for both Andersons, we do not know if Lauralynn E. Downing had informed the many Republican / Conservative operatives who she enlisted that she was also helping a Democratic candidate, who is running in opposition to a Republican / Conservative Collette Lafuente, Mayor of the City of Poughkeepsie.

Page 18 of Anderson’s “petition” shows that Marianne Anderson also carried a Democratic-Republican petition.   We believe that Marianne Anderson is the daughter of Richard Anderson, the Democratic Candidate for County Clerk.  We do not know if Marianne told her father she was helping the Republican / Conservatives. 

A  Mary M. Anderson witnessed pages “15”, “16”, and “17” of the petition.  We do not know if she is a blood relation to either Richard Anderson or Butch Anderson, but we find the coincidence a little strange.

Page “21” of the petition was carried by a person whose identity is unknown to us, as we cannot read her signature.  However, the type set is the identical to that for the other Democratic-Republican petitions, so we think the pages were identical photocopies of the same original, distributed by one person to the others.

City of Poughkeepsie Independence Party Chair Resigns

Laura Downing resigned as chairwoman of the City of Poughkeepsie Independence Party Committee this week, citing disagreements with "certain rules" concerning the party's support for candidates for elected office.

In particular, Downing took issue with party rules that she says would have obligated her to support Candis Saint Angel, an Independence Party member and town resident who has declared his candidacy for the office of Dutchess County Sheriff in this fall's elections.

Saint Angel, a Town of Poughkeepsie resident for the last 40 years, said he is running with a group of three other candidates under the banner: "The Justice Team."

"I believe there's too much corruption in Dutchess County and I'm going to do something about it," said Saint Angel in explaining his reason for adopting the phrase.

As for Downing's assertions, Saint Angel said the Independence Party's rules require support for his candidacy, as well as any other party member's effort to win the office. "The rules state very clearly...any member of the party is to be supported by each and every member of the committee," he said, adding that he has been "laboring for the last two years" in preparation for this campaign.

b.         The attachment of the Independence Party Certificate of Authorization of Adrian “Butch” Anderson to the Adrian “Butch” Anderson Petition is NOT VALID

1.      The issuing of the Independence Party Certificate of Authorization of Adrian “Butch” Anderson, by there sworn Notarized signatures on July 10, 2003, projecting, Peter J. Barton as Presiding Officer and Lauralynn E. Downing as Secretary, officers of Authority and Committee members of the Independence Party (Exhibit “C”)  

2.      The issuing of the Independence Party Certificate of Authorization of Adrian “Butch” Anderson, issued by Peter J. Barton and Lauralynn E. Downing, is in DIRECT OPPOSITION of the Rules of the Independence Party, Dutchess County Committee, (adopted October 12, 2002), Section 7-2 Authorizations pages 12 and 13 (Exhibits “D” & “E”), stating on page 13, #2 & #3 the following:

 

“However, in any event, a committee or officer which is empowered under these Rules to issue an authorization of the Independence Party for candidates not enrolled in the Independence Party ((pursuant to Election Law Section 6-120) MAY NOT AUTHORIZE AS A CANDIDATE OF THE PLATFORM OF THE INDEPENDENCE PARTY NEW YORK STATE COMMITTEE, or who, in gathering signatures on a Designating Petition for any public office as a candidate of the Independence Party, USED A NOTARY PUBLIC or a Commissioner of Deeds AS A WITNESS FOR ANY SIGNATURES OF A PARTY MEMBER ON SUCH DESIGNATING PETITION (i.e., all signatures on a Designating Petition must be witnessed by a member of the Independence Party).”

 

3.      On the Independence Party Certificate of Authorization of Adrian “Butch” Anderson, issued by Peter J. Barton and Lauralynn E. Downing, Lauralynn E. Downing, has sworn herself on July 10, 2003, to be the Secretary of the Independence Party Dutchess County Committee, AND IN FACT, Lauralynn E. Downing has perjured herself, when she knew that she had given her letter of resignation of May 4, 2003, stating that she “resigned from all offices in which she holds with the Independence Party, along with any affiliation she had with this party”. (Exhibit “H”)

4.      Lauralynn E. Downing, in her Letter to the Editor, stating the fact that she had resigned from the Independence Party, of which appeared in the Poughkeepsie Beat” under the title: “Independence Party Chair Resigns from Post” on May 9, 2003. (Exhibit “F”)

5.      Lauralynn E. Downing, gave a personal interview with Steve Densmore, Reporter for the “Poughkeepsie Beat”, stating the fact that she had resigned from the Independence Party, together with her reasons, of which appeared in the Poughkeepsie Beat” under the title: “Independence Party Chair Resigns from Post” on May 9, 2003. (Exhibit “G”)

6.      On the Independence Party Certificate of Authorization of Adrian “Butch” Anderson, issued by Peter J. Barton and Lauralynn E. Downing, Peter J. Barton, willingly and knowingly, assisted Lauralynn E. Downing in committing perjury on the sworn, Notarized Certificate of Authorization. (Exhibit “C”)  

7.      Peter J. Barton and Lauralynn E. Downing have sworn to FALSE INFORMATION and have issued a FALSE CERTIFICATE (§175.40) with the issuing of the Independence Party Certificate of Authorization of Adrian “Butch” Anderson, to the Dutchess County Board of Elections. (Exhibit “B”)

8.      The Independence Party Certificate of Authorization of Adrian “Butch” Anderson to the Adrian “Butch” Anderson Petition (Exhibit “C”) filed with the Dutchess County Board of Elections is a FALSE CERTIFICATE and is NOT VALID by Specification of Objections and Exhibits herein, and WE DEMAND THAT IT BE DISPOSED OF IMMEDIATELY, and in addition, whatever else the Dutchess County Board of Election Commissioners deem necessary.
